City seeks to join lawsuits against Ponca casino

The city of Council Bluffs, Iowa, is seeking to join two lawsuits aimed at stopping the Ponca Tribe from opening a casino.

The city plans to join lawsuits filed by the state of Iowa and the state of Nebraska. "We feel we have standings in both," city attorney Richard Wade told the The Council Bluffs Daily Nonpareil.

Both suits target a December 31, 2007, decision by the National Indian Gaming Commission that allows the tribe to build a casino in Carter Lake, Iowa. Carter Lake is across the river from Council Bluffs, home to three commercial casinos.

The Department of Justice is seeking dismissal of the Nebraska suit, noting that Carter Lake is not in Nebraska.

The board in Pottawattamie County, Iowa, also voted to support Iowa's lawsuit.
