Hearing set for Oneida Nation treaty rights case

The U.S. Supreme Court will hear arguments on January 11, 2005, in the Oneida Nation's treaty rights case.

The court is being asked to determine whether the tribe's reservation, as defined by the 1794 Treaty of Canandaigua, still exists. If so, then land the tribe buys within the reservation is considered Indian Country.

The city of Sherrill has tried to impose taxes on the tribe's land. A federal judge and the 2nd Circuit Court of Appeals have ruled that the treaty is still in force.
