Judge affirms Narragansett Tribe land-into-trust

A federal judge on Monday upheld a Bureau of Indian Affairs decision to take 31 acres of land into trust for the Narragansett Tribe.

U.S. District Court Judge Mary Lisi denied a summary judgment motion by the town of Charlestown and the state of Rhode Island. She granted a summary judgment motion in favor of the BIA and the Department of Interior.

The tribe intends to use the land for a housing project. Since it is out of the tribe's settlement area, state officials fear it will be used for a casino. The BIA took it in trust for non-gaming purposes.

The case is Carcieri v. Norton, No. 00-00375. The decision is not yet posted on the Rhode Island District Court webpage at http://www.rid.uscourts.gov.
